257.7b “Commercial quadricycle” defined.

Sec. 7b.

“Commercial quadricycle” means a vehicle that satisfies all of the following:

(a) The vehicle has fully operative pedals for propulsion entirely by human power.

(b) The vehicle has at least 4 wheels and is operated in a manner similar to a bicycle.

(c) The vehicle has at least 6 seats for passengers.

(d) The vehicle is designed to be occupied by a driver and powered either by passengers providing pedal power to the drive train of the vehicle or by a motor capable of propelling the vehicle in the absence of human power.

(e) The vehicle is used for commercial purposes.

(f) The vehicle is operated by the owner of the vehicle or an employee of the owner of the vehicle.

(e) consuming marihuana in a public place or smoking marihuana where prohibited by the person who owns, occupies, or manages the property, except for purposes of this subdivision a public place does not include an area designated for consumption within a municipality that has authorized consumption in designated areas that are not accessible to persons under 21 years of age;

(g) consuming marihuana while operating, navigating, or being in physical control of any motor vehicle, aircraft, snowmobile, off-road recreational vehicle, or motorboat, or smoking marihuana within the passenger area of a vehicle upon a public way;

Pedal pushing along, Kalamazoo approves quadricycles ordinance

KALAMAZOO, MI — The city of Kalamazoo now has guidelines for anyone who wants to operate a commercial quadricycle service.

Those are the rolling six- to 14-person pedaled vehicles that are being used for bar-hopping, brewery-hopping and sightseeing in other cities.

In July, the Michigan Legislature enacted measures amending the Michigan Vehicle Code, Public Act 300 of 1949, to permit the operation of “commercial quadricycles” on public streets and to permit local regulation of that form of vehicular transportation.

The same month, Gov. Rick Snyder signed legislation allowing passengers to consume alcohol while on board, if local ordinances allow.

Although the City of Kalamazoo’s new ordinance, thus far, does not allow passengers to consume alcohol while they pedal, the state legislation allows passengers to consume drinks they bring with them, as they do with a quadricycle operation in Ann Arbor called Trolley Pub.

Operators of the vehicles cannot be under the influence and must have proof of liability insurance.

Quadricycles, sometimes referred to as pedicabs or, where alcohol is allowed, pedal pubs, have been making appearances in Grand Rapids, Holland, Traverse City and other Michigan cities. In information provided to the Kalamazoo City Commission, City Attorney Clyde Robinson stated that at least two operators of proposed quadricycles have approached the city about operating such vehicles next summer in downtown Kalamazoo.

Members if the Kalamazoo City Commission unanimously approved an ordinance Monday night that regulates such vehicles and provides rules for how they are used and maintained.

The approval was among actions taken Monday night at the commission’s last regular meeting of the year.

The ordinance to regulate commercial quadricycles defines them as: “A vehicle that has fully operative pedals for propulsion entirely by human power; has at least 4 wheels and is operated in a manner similar to a bicycle; has at least 6 seats for passengers; is designed to be occupied by a driver and powered either by passengers providing pedal power to the drive train of the vehicle or by a motor capable of propelling the vehicle in the absence of human power; is used for commercial purposes; and is driven by the owner of the vehicle or an employee of the owner of the vehicle.”

It requires that written permits must be acquired for their operation, that training must be provided to their drivers, and it outlines the lights and safety features each vehicle must have.

Among other things it states that quadricycle drivers must be at least 18 years old and be on record with the city of Kalamazoo.

The ordinance states: “No person shall operate or knowingly permit any other person to drive a quadricycle under the influence of intoxicating liquor or any controlled substance” and “No person shall consume or possess in a container which is open, uncapped or upon which the seal was broken, any alcoholic beverage within or on a quadricycle.”

It requires that all beverages consumed by passengers be contained in metallic or plastic containers.

The vehicles themselves may not be driven at more than 25 miles per hour, and  shall not be driven on sidewalks or on a trail intended for the use of pedestrians and non-motorized vehicles.
