A federal judge has sanctioned a settlement in a lawsuit against Timber Cannabis Co., a Michigan marijuana dispensary chain, over allegations of improperly retaining tips intended for employees. This agreement seeks to address claims that the company failed to distribute customer gratuities to the budtenders who rightfully earned them.
Timber Cannabis, which operates seven dispensaries across Michigan, has reached a settlement of $205,000 in a case that has garnered attention. While the company has not acknowledged any wrongdoing, this agreement signifies a noteworthy conclusion to a dispute that has prompted discussions about equitable labor practices within the cannabis sector.
The case was initiated by lead plaintiff Chad Underwood, who previously worked as a budtender at Timber Cannabis. Court documents reveal that Underwood stated he could earn up to $150 in tips per shift, a sum generously provided by pleased customers in jars or baskets positioned at the front counter.
However, in 2024, it is alleged that management started to collect these tips and retain them, depriving employees of their rightful earnings.
U.S. District Judge Matthew Leitman approved the deal, calling the terms “fair and appropriate” during a brief hearing. The settlement avoids a prolonged legal battle while providing compensation to the affected employees.
Timber Cannabis has firmly denied any violation of wage laws in its official response to the lawsuit, yet the company’s decision to settle reflects a strategic choice to move forward while avoiding both an admission of liability and the potential for extended litigation.
