On April 30, the Michigan Supreme Court issued an order dismissing the appeals case of Pinebrook, LLC versus the City of Warren, bringing an end to six years of litigation.

The discussion centers on the procedure for obtaining medical marijuana licenses in Warren, focusing on the city’s Marijuana Review Committee, which was tasked with evaluating and scoring applications. The main point of contention is the committee’s function, particularly whether it operated as a decision-making public body that fell under the purview of the Open Meetings Act.

Following the recommendations of the Marijuana Review Committee, the City Council chose 15 recipients to receive medical marijuana licenses after thoroughly reviewing over 60 applicants.

The case has been presented before the Macomb County Circuit Court, the Michigan Court of Appeals, and the Michigan Supreme Court.

In December, the Michigan Court of Appeals rendered a decision regarding the case, declaring that 15 medical marijuana licenses issued five years prior are now considered null and void, and subsequently remanded the matter to the Macomb County Circuit Court.
